Terms of Service

These Terms of Service (“Terms”) govern your use of the DailyBeBetter Coach. They cover the coaching subscription, in-app purchases, and your use of the app. The separate Soul Blueprint product is covered by Section 8.

These Terms are provided by Daily Be Better - F.Z.C, a UAE Ajman Free Zone company (License No. 55075), Ajman Free Zone C1 Building, B.C. 1308557, Ajman Free Zone, Ajman, United Arab Emirates.

The governing-law forum is being finalized with counsel. This document remains a draft pending counsel review.

1. Acceptance

By creating an account or using the DailyBeBetter Coach, you agree to be bound by these Terms. If you do not agree, do not use the service.

3. Eligibility

The service is for adults 18 years of age or older only. By using it, you confirm you are 18+. Age is self-declared at registration.

4. AI Disclosure

You are interacting with an AI coach (presented as “Arabella” or “James”), not a human. The voices and persona are AI-generated. This disclosure is provided in line with EU AI Act Article 50 transparency duties and is consistent with our Privacy Policy.

5. Subscriptions & Billing (Apple / Google In-App Purchase)

The DailyBeBetter coaching subscription is sold through Apple In-App Purchase and Google Play Billing. Apple and Google are the merchant of record for these purchases.

• What you get: the subscription (US$59.95 per month, including 120 session-minutes per billing period) gives you the included monthly coaching minutes.
• Auto-renewal: the subscription automatically renews at the end of each billing period until you cancel. Your chosen payment method (held by Apple or Google) is charged for each renewal.
• Managing and cancelling: you can manage or cancel your subscription at any time in your App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Merchant-of-record rails: because Apple and Google are the merchant of record, they own the cancellation, refund, and renewal-notice mechanisms for these purchases. Refund requests for in-app purchases are handled by Apple or Google.
• Annual plan: an annual plan (US$499.60 per year) may be offered as an alternative to the monthly plan; the same auto-renew, cancellation, and withdrawal terms in this section apply to it.
• Included minutes: your plan includes 120 coaching session-minutes per billing period. Included minutes are measured by the time you spend in active coaching sessions and do not roll over between billing periods. If you reach your included minutes, you can continue by purchasing minute packs (Section 6).
• Free trial: where a free trial is offered, it converts to a paid auto-renewing subscription at the end of the trial unless you cancel before it ends; trial terms (length and any included-minute cap) are shown at signup.

6. Minute Packs (Consumables)

In addition to the subscription, you can buy one-time minute packs to extend your included minutes:

• +60 minutes for US$37.99.
• +240 minutes for US$109.99.

Minute packs are consumable in-app purchases (Apple consumable / Google managed-product consumable type): once purchased and consumed, they are non-refundable, they do not roll over between billing periods, and they are used to extend your available coaching minutes. They are not a subscription and do not auto-renew.

7. EU / EEA + UK 14-Day Withdrawal Right

If you are a consumer in the EU / EEA or the UK, a 14-day statutory right of withdrawal applies to your subscription. Under EU/UK consumer law the coaching subscription is treated as a digital service, so the withdrawal window applies once per signup, beginning when the contract is concluded.

• Per signup, not per renewal: the withdrawal right applies to the initial subscription period and does not reset on each automatic renewal. This limits the right to one window per signup, not one per billing period.
• Operated by the store: for in-app purchases, Apple and Google operationalize the withdrawal and any refund at checkout as merchant of record.
• Withdrawal Button: the EU mandatory “Withdrawal Button” (Directive (EU) 2023/2673, effective 19 June 2026) binds traders that operate their own online checkout interface. The coaching subscription is purchased only through Apple / Google in-app purchase, so the Withdrawal Button is not applicable to the coaching purchase flow. We will re-check this if a web checkout for coaching is ever added.

8. Soul Blueprint (Separate Product)

The Soul Blueprint report is a separate product with its own terms, which continue to apply to that product:

• Soul Blueprint provides an AI-generated birth-report based on numerological, astrological, and archetypal analysis of your birth details.
• Soul Blueprint reports are for entertainment and personal insight only — they are not professional advice of any kind and are not scientifically validated predictions.
• Soul Blueprint is a one-time purchase processed through Stripe. Because the report is a digital good delivered electronically, all sales are final; if a report is not delivered due to a technical error, contact office@dailybebetter.com and we will re-deliver it or issue a full refund.

These Soul Blueprint terms are scoped to the Soul Blueprint product only and do not apply to the coaching subscription.

9. Acceptable Use, Intellectual Property & Your Responsibilities

• Lawful use: use the service only for lawful purposes. Do not attempt to reverse-engineer, decompile, or disrupt the service.
• Our property: the DailyBeBetter brand, app, design, and templates are ours.
• Your content: the information you share and the recaps generated for you are yours to keep.
• Accuracy: provide accurate information so your coaching is grounded in your actual situation.

10. Data & Privacy

How we collect, use, store, and share your data is described in our:

• Privacy Policy — the general privacy notice covering all data we process.
• Consumer Health Data Privacy Policy — a separate, standalone policy required by Washington’s My Health My Data Act, covering consumer health data we collect from or about Washington consumers.

By using the service you acknowledge those policies. Coaching uses sensitive personal information you choose to share; you control what you share and can withdraw consent and delete your account and data at any time (in-app or via /delete-account).

11. Account & Termination

• Your account: one active account per person; keep your credentials secure.
• Suspension / termination by us: we may suspend or end access for breach of these Terms or unlawful use, subject to applicable law.
• Ending by you: you can stop using the service and delete your account at any time; deleting your account wipes your coaching data from our systems (see Section 10). Cancelling a subscription follows Section 5.

12. Disclaimers & Limitation of Liability

The service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We are not liable for decisions you make based on coaching content. To the maximum extent permitted by law, our total liability is limited to the amount you actually paid for the service in the period giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates, and disputes shall be resolved in the courts of Dubai / Ajman, UAE. [Forum and governing-law clause to be confirmed with counsel after incorporation.] Mandatory consumer-protection rights you have under the law of your country of residence (including, for EU/EEA and UK consumers, the rights in Section 7) are not affected by this clause.
